Annual Increase in Tribunal Awards

The Employment Rights (Increase of Limits) Order 2004 was made on 10 November 2004 and applies where the appropriate date falls after 1 February 2005.

The main increases in compensation limits are:

·         the maximum compensatory award for unfair dismissal will increase from £55,000 to £56,800;

·         the maximum amount for a week's pay (for calculating basic award or redundancy payment) will increase from £270 to £280; and

·         the limit on the amount of guarantee payment payable to an employee in respect of any day will increase from £17.80 to £18.40.

As there is no statutory cap on the amount a tribunal can award in, for example, discrimination cases, the order does not cover them.

The Employment Rights (Increase of Limits) Order 2004 includes a full list of the increases and can be found at http://www.legislation.hmso.gov.uk/si/si2004/20042989.htm.
